If I Filed A Standard Disability Claim, When Should I Upload Evidence?

 

Upload your evidence as soon as you can.

You can continue uploading documents for up to one year from the date we receive your claim. But, if you don’t provide any evidence or give us the information we need to help you get evidence within 30 days, we may make a decision on your claim earlier.

If we decide your claim early, you’ll still have the rest of the one-year period to provide more information or evidence.

 

What Happens If I Upload More Evidence After I’ve Submitted A Fully Developed Claim?

 

We’ll remove your disability claim from the Fully Developed Claims program and process it as a standard claim.

If we decide your claim earlier than one year from the date we received the claim, you’ll still have the rest of the year to provide any additional information or evidence.

 

What Kind Of Documents Should I Upload To Support My Disability Claim?

 

Federal and state records

These include copies of:

  • Your military medical records
  • Your military personnel records
  • Any Social Security Administration or other federal or state medical treatment records
  • Any treatment or personnel records from your National Guard or Reserve unit that support your claim (if you’ve served in either of these branches)

If you don’t have copies of these records, you can ask us to request them for you as part of the claim process.

Private medical treatment records

If you’ve seen a non-VA health care provider for diagnosis or treatment, you’ll need to upload copies of all medical records that can provide information about the disability you’re claiming.

These may include evidence like:

  • Doctor’s reports
  • X-rays
  • Medical lab or test results

Veterans’ Medical and Health Records

The Official Military Personnel Files (OMPF), held at the National Personnel Records Center (NPRC), are administrative records containing information about the subject’s military service history. Many OMPFs contain both personnel and former active duty health records, but the service branches discontinued retiring the health record portion to the NPRC in the 1990s.

In the past, all of the military services retired the individual health record, along with the personnel record, to the NPRC upon a service member’s separation from service. The Army and the Air Force retired its health records with the Official Military Personnel File, while the Department of the Navy (including the Navy, Marine Corps and Coast Guard) retired these files separately to the NPRC until the 1980s.

Health records cover the outpatient, dental and mental health treatment that former members received while in military service. Health records include induction and separation physical examinations, as well as routine medical care (doctor/dental visits, lab tests, etc.) when the patient was not admitted to a hospital.

In comparison, clinical (hospital inpatient) records were generated when active duty members were actually hospitalized while in the service. Typically, these records are NOT filed with the health records but are generally retired to the NPRC by the facility which created them (see clinical records for more information). Medical records from the Department of Veterans Affairs (VA) are also not included.

In the 1990s, the military services discontinued the practice of filing health records with the personnel record portion at the NPRC. In 1992, the Army began retiring most of its former members’ health records to the Department of Veterans Affairs (VA). Over the next six years, the other services followed suit. In 2014, the military services dicontinued the practice of retiring the records to the Department of Veterans Affairs (VA). Discharge Upgrade  

Less than Honorable discharge

Even with a less than honorable discharge, you may be able to access some VA benefits through the Character of Discharge review process. When you apply for VA benefits, we’ll review your record to determine if your service was “honorable for VA purposes.” This review can take up to a year. Please provide us with documents supporting your case, similar to the evidence you’d send with an application to upgrade your discharge.

You may want to consider finding someone to advocate on your behalf, depending on the complexity of your case. A lawyer or Veterans Service Organization (VSO) can collect and submit supporting documents for you.             Find a VSO near you. 

Note: You can ask for a VA Character of Discharge review while at the same time applying for a discharge upgrade from the Department of Defense (DoD) or the Coast Guard.

If you need mental health services related to PTSD or other mental health problems linked to your service (including conditions related to an experience of military sexual trauma), you may qualify for VA health benefits right away, even without a VA Character of Discharge review or a discharge upgrade.If your previous upgrade application was denied, you can apply again, but you may have to follow a different process.
